1. Introduction

These Terms of Service ("Terms") govern your access to and use of the E-Ye website located at e-ye.co.uk ("the Site"), operated by Clive Marshall, a sole trader registered in England ("we", "us", "our").

E-Ye provides Glasses, sunglasses and eyewear from UK retailers. We may modify, suspend or discontinue any aspect of the service at any time without prior notice. We shall not be liable to you or any third party for any modification, suspension or discontinuation.

4. User Accounts

Where the Site offers user registration:

• You must provide accurate, complete and current information;
• You are responsible for maintaining the confidentiality of your account credentials;
• You are responsible for all activity that occurs under your account;
• You must notify us immediately of any unauthorised use at cm@clivemarshall.com;
• We reserve the right to suspend or terminate accounts that violate these Terms.

5. User Responsibilities

All content on this Site — including but not limited to text, images, graphics, logos, icons, software, audio, video, and the overall design and layout — is the property of E-Ye or its licensors, and is protected by United Kingdom and international copyright, trademark and intellectual property laws.

You may not reproduce, distribute, modify, create derivative works from, publicly display, or otherwise exploit any content from this Site without our prior written consent, except as permitted by law (e.g., fair dealing for criticism or review).

If you submit content to the Site (reviews, comments, photos, etc.), you grant us a non-exclusive, royalty-free, worldwide licence to use, display and distribute that content in connection with our services.

• All prices are displayed in the applicable currency and include VAT where required by UK law;
• Payments are processed through our third-party payment provider(s) (e.g., PayPal, Stripe). Your use of such services is subject to their terms;

• We reserve the right to change our pricing at any time, though existing orders will be honoured at the price confirmed;
• Access to paid services or delivery of digital products will be provided upon successful payment confirmation.

9. Cancellation and Refund Policy

• Digital products and services: As permitted under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, once a digital product has been accessed or downloaded, the right to cancel may be lost. You will be informed of this before purchase.
• Subscriptions: You may cancel a subscription at any time. Cancellation takes effect at the end of the current billing period. No partial refunds are given for the remaining period.
• Refund requests: If you believe you are entitled to a refund, please contact us at cm@clivemarshall.com within 14 days of purchase. Each request is reviewed on a case-by-case basis.
• Statutory rights: Nothing in these Terms affects your statutory rights as a consumer under UK law.

10. Limitation of Liability

To the maximum extent permitted by law:

• The Site and its content are provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied;
• We do not warrant that the Site will be uninterrupted, error-free, secure, or free of viruses;
• We shall not be liable for any indirect, incidental, special, consequential or punitive damages arising from your use of the Site;
• Our total aggregate liability to you for any claim arising from these Terms or your use of the Site shall not exceed the amount you have paid us (if any) in the 12 months preceding the claim;
• Nothing in these Terms excludes or limits our liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by English law.

11. Indemnification

You agree to indemnify and hold harmless Clive Marshall, trading as E-Ye, from and against any claims, damages, losses, liabilities and expenses (including reasonable legal fees) arising from your use of the Site, your violation of these Terms, or your infringement of any third-party rights.

12. Data Protection

13. Termination

We may terminate or suspend your access to the Site immediately, without prior notice or liability, for any reason, including breach of these Terms. Upon termination, your right to use the Site ceases immediately. If any provision of these Terms is found to be invalid, illegal or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and us regarding the use of the Site and supersede all prior agreements and understandings.

16. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these Terms or your use of the Site shall be subject to the exclusive jurisdiction of the courts of England and Wales.
